Parking Regulations By-law

Being a by-law to regulate parking within Norfolk County.

1. Short title

This By-Law shall be known as the "Norfolk County Parking By-Law".

2. Definitions

BOULEVARD - shall mean that area located between the roadway and the sidewalk, or where there is no sidewalk, the area between the roadway and the property line of the adjacent property.

CIITEF FIRE OFFICIAL - shall mean the person designated by the Corporation as the Chief Fire Official.

CORPORATION -shall mean the Corporation ofNorfolk County.  CROSSWALK -shall mean:

a) that part of a highway at an intersection that is included within the connections of
the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or

b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or other marking on the surface..

CURB - shall mean a structure composed of concrete or other suitable material erected to define the edge of the roadway.

DESIGNATED PARKING SPACE - shall mean a parking space on any property, designated by a sign conforming to subsection 6.2, indicating that the space is for the exclusive use of a vehicle displaying a valid Disabled Person Parking Permit.

DISABLED PERSON PARKING PERMIT - shall mean a permit, issued under the conditions, terms and requirements of the Highway Traffic Act R.R.O 1990, Regulation 581.

DRIVEWAY - shall mean a part of a highway improved to provide vehicular access from the roadway to a laneway or a parking area on adjacent land.

FAIR WEEK- shall mean the first Monday of October until the second Tuesday of October of any year.

FIRE ROUTE - shall mean any private access, route, road, way, lane, ramp or other means of vehicular access to, or egress from a building and it may include part of a parking lot set aside for use by emergency vehicles.

HIGHWAY - shall include the entire right-of-way of a common and public highway, street, lane, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles.

HOLIDAY - shall mean holidays as defined under the Interpretations Act, R.S.O. 1990, as amended.

INTERSECTION - shall mean the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral edges of two or more roadways which join one another at an angle, whether or not one highway crosses the other

LANEWAY - PARKING LOT - shall mean a lane; aisle, passageway or access way intended for general traffic circulation within a parking lot, which affords a means of access for vehicles to the driveways and parking spaces.

LANEWAY - MUNICIPAL - shall mean a lane, passageway, alleyway, fire lane or access way which is municipally owned, or under control of the Corporation, not intended for general traffic circulation, but which affords a means of access for vehicles behind or between properties.

LOADING ZONE - shall mean that part of a highway set apart for the exclusive purpose of parking or stopping a vehicle to load or unload goods, wares, merchandise or persons.

MOTOR VEHICLE - shall include an automobile, motorcycle, motor assisted bicycle, unless otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power.

MUNICIPAL LAW ENFORCEMENT OFFICER - shall mean a person appointed by the Council of the Corporation of Norfolk County for the purposes of enforcing County by laws and for the purposes of this By-Law shall include the Ontario Provincial Police.

MUNICIPAL PARKING LOT - shall mean any parking lot owned or under control of the Corporation, improved and intended to provide vehicle parking for the public and includes but is not limited to parking lots located at Corporation offices, buildings, sporting and recreational facilities, and municipally owned parking lots in shopping districts.

MUNICIPAL PARK OR OPEN SPACE - shall mean any publicly accessible land owned or under control of the Corporation, and is generally used by the public for recreation or open space, and includes areas such as traffic islands.

OFFICIAL SIGN - shall mean a sign approved by the Ministry of Transportation and shall also include, for the purposes ofthis bylaw, yellow, blue or red painted curbs.

ONE-WAY HIGHWAY - shall mean a highway upon which the movement of vehicular traffic is limited to one direction.

PARK OR PARKING - when prohibited means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.

POLICE AND EMERGENCY VEHICLE ZONE - Shall mean a parking space or parking spaces designated for the exclusive use of Police or emergency vehicles.

ROADWAY - shall mean the travelled portion of a highway that is improved, designed and ordinarily used for vehicular traffic but does not include the shoulder.

SHOULDER - shall mean that part of the highway immediately adjacent to the roadway and having a surface which has been improved.     

SIDEWALK - shall include all parts of highway as are set aside by the Corporation for the use of pedestrians or used by the general public for the passage of pedestrians.

STAND OR STANDING - when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers.

STOP OR STOPPING - when prohibited, means the halting of a vehicle even momentarily, whether occupied or not except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or a traffic control sign or signal.

TRAFFIC - shall include pedestrians, animals which are led, ridden or herded, vehicles and other conveyances using a highway for the purpose of travel.

TRAILER - shall mean a vehicle that is, at any time, drawn upon a highway by a vehicle, or any other device or apparatus not designed to transport persons and property, which is temporarily drawn, propelled, or moved upon a highway, except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn.

UNLICENSED - shall mean without a licence plate attached thereto or without a validated licence plate attached thereto where such licence plate is required to operate the vehicle on a highway

VEHICLE - shall include a motor vehicle, trailer, traction engine, farm tractor, road building machine and a vehicle drawn, propelled or driven by any kind of power; including a motorized snow vehicle.

3. Interpretation

3.1 In this By-Law:

a) words imparting the singular number or the masculine gender only, include more persons, parties or things of the same kind and females as well as males and the converse.

b) a word interpreted in the singular number has a corresponding meaning when used in the plural.

c) "may" shall be construed as permissive.

d) "shall" shall be construed as imperative.

3.2 Where an expression of time occurs or where an hour or other period of time is stated, the time referred to in this By-Law shall be the local time whether standard or daylight savings time.

3.3 The headings contained in this By-Law are for the purposes of convenience and reference only and do not form part of this By-Law.

3.4 Where a distance is used in this By-Law or the attached schedules as part of a prohibition of parking or stopping within a specified distance of an object, structure, land or a part of a highway, the distance shall be measured

a) along the curb or edge of the roadway from a point on the curb or edge of roadway opposite the object, structure, land or part of a highway, unless the context otherwise requires, and

b) from the object, structure, land, part of a highway or edge of a roadway in all directions.

4. General provisions

4.1 Notwithstanding other provisions of this By-Law, in the case of an emergency, parade, an assembly of persons, congestions of traffic, a construction project, or any other emergency, parking may be restricted or prohibited by a Municipal Law Enforcement Officer and any such restrictions or prohibitions shall be complied with.

4.2 No person shall move, remove, interfere with, or install a facsimile of an official sign.

4.3 Where there are pavement markings designating parking spaces no person shall park a vehicle where it is not wholly within the designated parking space.

4.4 No person shall park an unlicensed vehicle on a municipal parking lot or highway.

4.5 No person shall park an inoperable vehicle on a municipal parking lot or highway.

4.6 No person shall park a vehicle so as to obstruct the passage of vehicles in a parking lot laneway of any parking lot.

4.7 Attached Schedules A, B, C and D shall be deemed to form part of this By-Law.

4.8 No person shall park a trailer on a municipal parking lot or highway unless it is attached to a licensed motor vehicle.

5. Exemption from parking regulations

5.1 The provisions of this By-Law shall not apply to:

a) Police vehicles, emergency vehicles, Corporation vehicles, other Provincial and Federal government vehicles and Public Utility vehicles such as hydro, gas, telephone and cable TV: while being used by the respective employees actually engaged in the performance of their duties.

b) Vehicles where an exemption permit has been issued by the Manager of Building and By-Law or designate and where the exemption permit is prominently displayed on or in the vehicle.

c) Vehicles forming part of a funeral cortege provided vehicles are parked on only one side of the highway and are not parked in contravention of any part of subsection 8.5.

5.2. Where an application has been made to the Manager of Building and By-Law for a parking exemption permit as per subsection 5.1b), a fee may be charged to the applicant in accordance with the Norfolk County Fees By-Law.

6. Designated spaces for disabled parking

6.1 Every owner of a parking facility designed and available for use by the public shall provide a minimal number of Designated Parking Spaces as required by the applicable zoning by-law of the Corporation as amended from time to time.

6.2 Each Designated Parking Space shall be distinctly indicated by an official sign in a form and content as prescribed by the Highway Traffic Act R.S.O., 1990c. H.8 as amended and the regulations made there under. (See Schedule D)

6.3 No person shall park, stand or stop a vehicle, or permit a vehicle to remain parked, standing or stopped at any time, in any Designated Parking Space, including Designated Parking Spaces adjoining a highway or roadway, unless a valid Disabled Person Parking Permit is displayed as described in Subsection 6.4

6.4 The Disabled Person Parking Permit in Subsection 6.3 shall be displayed on the sun visor or dashboard of the vehicle so the international symbol of access for the disabled, the permit nUlllber and the expiry date are clearly visible from outside the vehicle.

6.5 No person shall park, stand or stop a vehicle, or permit a vehicle to remain parked, standing or stopped at any time, in any Designated Parking Space if the vehicle is not transporting or picking up the Person with a Disability to whom the Disabled Person Parking Permit was issued.

6.6 Upon request, every person having possession of a Disabled Person Parking Permit shall surrender the permit to an Officer for reasonable inspection in accordance with the provisions of the Highway Traffic Act, Section 28(1), R.S.O. 1990, as amended.

6.7 An Officer to whom a Disabled Person Parking Permit has been surrendered may retain it until disposition of the case in accordance with the provisions of the Highway Traffic Act, Section 28(2), R.S.O. 1990, as amended.

7. Parking regulations under schedule

7.1 For the purposes of this section, any vehicle which has not been moved a distance of 18 metres (60 feet) from its original parking location, shall be deemed to have not been moved, and to have remained parked.

7.2 Notwithstanding the provisions of Section 8 of this By-Law, for the respective zone stated in column 8 of attached Schedules A and B, when official signs have been erected and are on display, no person shall park, stand or stop a vehicle in the locations stated in columns 1 to 4 inclusive; on the side of the highway or location specified in column 5; during the restricted times stated in column 6, during the days stated in column 7;

a) in excess of two consecutive hours during the restricted times in a 2 HOUR PARKING zone

b) in excess of 1 hour during the restricted times in a 1 HOUR PARKING zone

c) in excess of 15 minutes at any time during the restricted times in a 15 MINUTE PARKING zone

d) at any time during the restricted times in a PROHIBITED PARKING zone

e) except on an angle in an ANGLE PARKING zone.

f) at any time during the restricted times in a NO STOPPING zone.

g) at any time during the restricted times in a DESIGNATED LOADING zone

h) .at any time in a POLICE AND EMERGENCY VEHICLE zone unless the vehicle is a police or emergency vehicle

i) at any time in a TAXI zone, unless the vehicle is licenced by Norfolk County as a taxi and the vehicle is actually engaged in picking up or discharging passengers or cargo.

j) in excess of 48 hour consecutive hours in a RESTRICTED PARKING 48 HOURS zone a vehicle, trailer, recreational vehicle (RV), or tow vehicle.

k) in excess of four consecutive hours during the restricted times in a 4 HOUR PARKING zone.

On-street parking

8. Parking or standing prohibitions without signs

8.1 Except as otherwise permitted in this By-Law, no person shall park or stop a vehicle on a highway except on the right-hand side of the highway, having regard to the direction in which the vehicle is required to proceed.    

8.2 Except where parking is otherwise prohibited, the parking or stopping of a vehicle on the left-hand side ofa highway designated for one-way traffic is permitted.

8.3 Except where angle parking is permitted by this By-Law, when parked on a highway, the front and rear wheels or runners.shall be parallel to and not more thanJO cm from the curb or the edge of the roadway as is practicable without stopping or parking over a sidewalk or any part of the highway which is not intended for the use of vehicles.

8.4 Where angle parking is permitted on a highway, no person shall park or stop a vehicle except at the angle as indicated by pavement markings, or if not indicated by pavement markings, then at an angle of 45  from the curb or limit of the highway, with the front end of the vehicle at the curb or limit.

8.5 Notwithstanding any other section of this By-Law, no person shall park or stand a vehicle or permit a vehicle to remain parked or standing on a highway,

a) within 9 metres of an intersection nnless signage or pavement markings indicate a lesser distance;

b) within 3 metres of a fire hydrant;

c) so as, in the opinion of the Municipal Law Enforcement Officer, to obstruct ingress to, or egress from a driveway;

d) unless there are pavement markings installed by the Corporation designating parking spaces, not less than 1.2 metres of a driveway, measured from the curb cut or where there is not a curb cut, from the intersection of the prolonged edge of travelled portion of the driveway and the edge of the roadway;

e) so as to obstruct the removal of any other vehicle previously parked or standing;

f) for the purpose of maintaining or repairing the vehicle, except for any repairs that have been necessitated by an emergency;

g) except as permitted in Section 7.2G) of this By-Law, a motor vehicle, recreational vehicle (RV), tow vehicle or trailer or any combination of these vehicles if attached, over 8 metres in length or 2.2 metres in height for a time period in excess of two consecutive hours;

h) where ice and snow is being, or is to be removed.

i) on or across a sidewalk of part thereof;

j) on a crosswalk or part thereof

k) in a manner to obstruct traffic;

l) where the highway is 6 metres wide or less;

m) on a boulevard or part thereof;

n) within 15 metres of a railway crossing;

o) on a bridge or any approach thereto;

p) for a period of more than 48 consecutive hours.

9. Prohibited parking or stopping where official signs are on display

9.1 Where authorized official signs have been erected and are on display, no person shall park or stop a vehicle, or permit a vehicle to remain parked or stopped on any highway:

a) within 7.5 metres of an entrance to a hospital;

b) within 7.5 metres from the driveway to a Fire Hall or Ambulance Base on the same side of the highway as the Fire Hall or Ambulance Base and not within 100 metres from the driveway on the opposite side of the highway to that of the Fire Hall or Ambulance Base;

c) except for a school bus, on both sides of the highway contiguous to the limit of the land used for school purposes, on school days from 8:30 a.m. to 4:30 p.m.

Off - Street parking

10. Responsibilities of property owner

10.1 It shall be the responsibility of the owner of the property upon which there is a designated Fire Route or Disabled Person Parking Space to erect and maintain all official signs.

11. Fire routes

11.1 It shall be the responsibility of the owner of the property upon which there is a designated Fire Route to ensure the Fire Route is maintained in good repair and is kept free of all obstructions and is cleared of snow and ice.

11.2 The owner of a property, before erecting Fire Route signage, shall obtain direction from, and the approval of the Chief Fire Official or his designate to ensure adequate wording and suitable location for such signage.

11.3 Fire Route signs in place at the time of enactment of this By-Law are permitted and may remain in place and may be the subject of enforcement for a period of five (5) years from the date of this By-Laws enactment.

11.4 No person shall park a vehicle, at any time, on or along or within a designated Fire Route on all properties listed in Schedule C.

12. Parking on municipal property

12.1 No person shall park a vehicle, or permit a vehicle to remain parked in any Municipal Parking Lot listed in Schedule B for a period of more than 48 consecutive hours.

12.2 When official signs have been erected and are on display, no person shall park a vehicle or permit a vehicle to remain parked on any Municipal Laneway.

12.3 No person shall park a vehicle, or permit a vehicle to remain parked in any Municipal Park or any Municipal Open Space including traffic islands, at any time except in a Municipal Parking Lot.

13. Parking on private property

13.1 No person shall park a vehicle or permit a vehicle to remain parked on private property without the consent of the owner of the property.

13.2 When official signs have been erected and are on display, no person shall park a vehicle or permit a vehicle to remain parked in any parking lot located on private property listed in Schedule C for a period in excess of 15 minutes where the lot or portion thereof has been designated as a 15 MINUTE PARKING zone in Colunm 8 of Schedule C.

13.3 When official signs have been erected and are on display, no person shall park a vehicle or permit a vehicle to remain parked in any parking lot located on private property listed in Schedule Cina space designated as a POLICE AND EMERGENCY VEIDCLE PARKING zone stated in Colunm 8 of Schedule C.

13.4 Where an owner of a property has posted signs stating conditions on which a motor vehicle may be parked or left on the property or prohibiting the parking or leaving of a vehicle on the property, a vehicle left on the property contrary to such conditions or prohibition shall be deemed to have been parked without consent.

13.5 For the purposes of Subsection 13.4, the owner of a property shall submit a written request for enforcement, which shall clearly indicate those conditions to the Corporation's By-Law Enforcement Division.

14. Penalties

14.1 When a vehicle is found parked, stopped or standing in contravention of the provisions of this By-Law, a Municipal Law Enforcement Officer may attach to the vehicle a serially numbered parking infraction notice stating the:

a) date and time of the violation;

b) licence number of the vehicle;

c) make of the vehicle;

d) location of the vehicle;

e) expiry date of the licence plate;

f) reason for which the parking infraction notice is being issued;

g) signature of the issuing Officer.

14.2 The parking infraction notice and the certificate of offence shall be in the form prescribed in the Ontario Regulations made under the Provincial Offences Act, R.S.O., 1990, as amended.

14.3 The parking infraction notice shall be prepared in duplicate and the parking infraction notice shall be served as prescribed in the Provincial Offences Act, R.S.O., 1990, as amended.

14.4 The owner of the vehicle upon receiving a parking infraction notice may make a  volunteer payment as set out on the face of the notice to the Corporation within seven (7) days of the service of the notice.

14.5 Upon the eighth (8th) day but within sixty (60) days from date of issue, a person being served with the parking infraction notice may pay the set fine as shown on the face of the parking infraction notice to the Corporation.

14.6 Any person who contravenes this By-Law is guilty of an offence and upon conviction is liable to a fine or penalty as provided for in the Provincial Offences Act, R.S.O., 1990, as amended.

15. Impoundment and removal

15.1 A Municipal Law Enforcement Officer upon discovery of any motor vehicle parked or standing in contravention of the provisions of this By-Law may cause it to be moved or taken to and placed or stored in a suitable location and all costs associated with its removal, and impoundment will be the responsibility of the registered owner of the vehicle.

15.2 Any perishable object in the vehicle removed from the highway is the property of the municipality upon being moved from the highway and may be destroyed or given to a charitable institution.

16. Enforcement

16.1 This By-Law shall be enforced by a Municipal Law Enforcement Officer.

16.2 A specially appointed By-law Enforcement Officer whose name appears in Column 9 of Schedule C may enforce this By-Law only on the property on which the municipal address is listed beside his/her name in Schedule C.

17. Severability

17.1 In the event that any of the provisions of this By-Law are deemed ultra vires by any Court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.

18. Repeal

18.1 The following By-Laws are hereby repealed in their entirety.

Norfolk County By-Law 2003-160 and any amendments thereto Norfolk County By-Law 2003-188 and any amendments thereto Norfolk County By-Law 2003-214 and any amendments thereto Town of Simcoe By-Laws 86-6, 86-7 and any amendments thereto

19. Effective date

19.1 This By-Law shall become effective upon the passing thereof and upon the approval of the set fines by the Regional Senior Justice of the Ontario Court of Justice.

Enacted and passed this 8th day of November, 2011.
