Being a by-law to regulate the external use of water by premises served by Norfolk County owned water systems.
I. Definitions
1.1 "Consumer" shall mean a recipient of County supplied water whether owner or tenant of the property;
1.2 "County" and "Norfolk County" shall mean The Corporation of Norfolk County;
1.3 "Manager" shall mean the General Manager of the Public Works and Environmental Services Department;
1.4 "Municipal Law Enforcement Officer" shall mean a person appointed by the Council of The Corporation of Norfolk County for the purposes of enforcing County by-laws and for the purposes of this by-law shall include the Ontario Provincial Police.
1.5 "Even" shall mean any number ending in the numerals 0, 2, 4, 6, 8;
1.6 "External Use Of Water" shall mean the use of water outside of any premise for purposes such as, but not limited to, the watering of lawns or other vegetation, the complete or substantially complete filling of swimming pools or the washing of vehicles or driveways;
1.7 "Odd" shall mean any number ending in the numerals I, 3, 5, 7, 9;
1.8 "Premises" shall mean a property and its apparent owner or tenant, as determined from the latest assessment roll or related documents, supplied with water by Norfolk County;
1.9 "Street Number" shall mean an urban street address or a rural 9-1-1 number;
1.10 "Water" shall mean water supplied by Norfolk County municipal water systems;
1.11 "Water System" shall mean any or all of the following communal water facilities owned and operated by Norfolk County, located in the urban areas of: Courtland, Delhi, Port Dover, Port Rowan, Simcoe and Waterford.
2. External water regulations
2.1 External water regulations shall apply May I to September 30 in each year following the passage of this By-Law.
2.2 No person shall use, cause or permit the use of water externally through a hose, pipe or other watering device or mechanism, except in accordance with the following:
- from 9:00 a.m. until 11:00 a.m. and from 7:00 p.m. until 10:00 p.m. on premises with even street numbers on even numbered days of the calendar;
- from 9:00 a.m. until I 1:00 a.m. and from 7:00 p.m. until I0:00 p.m. on premises with odd street numbers on odd numbered days of the calendar;
3. External water regulations-exemptions
3.1 Watering of newly planted sod is permitted during installation and during the following 24 hours after the installation.
4. Enforcement
4.1 For the purposes of enforcement of this By-Law, officers, employees or agents of the County, upon reasonable apprehension that a violation has occurred or is occurring, may enter upon the external premises of a water system consumer.
4.2 The Municipal Law Enforcement Officer shall enforce this by-Jaw.
5. Emergency or system maintenance water use regulations
5.1 The Manager is hereby authorized to implement at any time, regulations which he/she in his/her discretion, considers advisable to limit the external use of water and this authority includes the right to ban completely, the external use of water.
5.2 Notwithstanding, the provisions of this By-Law upon a water supply emergency being declared by Council, the provisions of Section 2 and Section 3 of this By-Law shall be suspended.
5.3 Upon notification of a water use regulation issued by the Manager, it is prohibited to use water except in accordance with the provisions of the regulation.
5.4 Separate regulations may be made for each water system.
5.5 Notwithstanding the provisions of this By-Law, the Manager is hereby authorized to carry out activities related to the property maintenance and operations of the water systems.
6. Severability
6.1 In the event that any of the provisions of this by-law are deemed ultra vires by any Court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.
7. Penalty
7.1 Every person who contravenes this by-law is guilty of an offence and upon conviction is liable to a fine or penalty as provided for in the Provincial Offences Act, R.S.O. 1990, as amended.
8. Repeal
8.1 That Section 13 and Schedule "A" of the former Regional Municipality of Haldimand Norfolk By-Law 53-00 are hereby repealed in their entirety.
9. Effective date
9.1 That the effective date of this by-law shall be the date of final passage thereof.
